Montana Attorney General Austin Knudsen filed a lawsuit against OpenAI in Lewis and Clark County, and the case is proceeding in state court.
The lawsuit alleges that ChatGPT can endanger children and teenagers by providing harmful advice and failing to adequately protect young users. Knudsen said he wants OpenAI to change its approach to consent, parental consent and age verification.
OpenAI says fictional sexual roleplay involving children violates its child-safety policies. The company says it detects and blocks those attempts, bans related accounts and reports apparent child sexual abuse material cases to the National Center for Missing & Exploited Children.
Knudsen said OpenAI has 90 days to respond before discovery phases begin. “They haven’t even responded yet. They’ve got 90 days to respond,” he said.
The Montana Attorney General’s Office expects a response from OpenAI in the coming weeks. Knudsen also said, “This thing is not ready for primetime.”
