Montana Attorney General Austin Knudsen sued General Motors and OnStar, alleging the companies violated the state’s Unfair Trade Practices and Consumer Protection Act.

The lawsuit alleges GM and OnStar deceptively enrolled customers in a program that shared driving data. It claims the data was sold to brokers without customers’ consent and later provided to insurance companies, which allegedly used it to raise customers’ rates.

The data identified in the lawsuit includes vehicle speed, seatbelt-buckle status, hard-braking events and other driving information. The complaint also alleges employees received commissions for enrolling customers and warned some reluctant customers that certain safety features would not be available without enrollment.

“GM engaged in deceptive practices by taking Montanans driving data and selling it to other brokers without their permission,” Knudsen said. “That’s a violation of the law and I will hold them accountable.”
